Terms of Service

These Terms of Service govern your access to and use of GamingSoft's casino gaming software platform. By accessing our services, you agree to these terms in full.

1. Service Agreement

GamingSoft provides B2B casino gaming software solutions to licensed operators only. Your use of our platform is subject to:

  • Valid gaming license in your jurisdiction
  • Completed KYC/AML verification
  • Signed Master Service Agreement
  • Payment of applicable fees as outlined in your contract

2. Operator Obligations

As a platform user, you must:

  • Maintain all required gaming licenses and regulatory approvals
  • Implement responsible gaming tools as mandated by local regulations
  • Process player data in compliance with GDPR, CCPA, and applicable privacy laws
  • Not reverse-engineer, copy, or redistribute our proprietary software
  • Report security vulnerabilities immediately to our technical team

3. Intellectual Property

All software, game content, and documentation remain the exclusive property of GamingSoft and our partner providers. Your license grants usage rights only - not ownership. Game content is subject to separate agreements with game studios.

4. Service Availability

We target 99.9% uptime but cannot guarantee uninterrupted service. Scheduled maintenance windows are announced 72 hours in advance. We're not liable for downtime caused by third-party services, DDoS attacks, or force majeure events.

5. Payment Terms

Revenue share percentages and platform fees are defined in your contract. We process settlements monthly with 15-day payment terms. Late payments may result in service suspension after 30 days.

6. Data and Privacy

Player data remains your property. We process it solely to deliver services. Our role is data processor - you're the data controller under GDPR. Review our Privacy Policy for details on data handling.

7. Termination

Either party may terminate with 90 days written notice. Immediate termination applies if:

  • Gaming license is revoked or suspended
  • Payment obligations aren't met after 60-day cure period
  • Material breach of regulatory requirements occurs

Upon termination, you must cease using our software and return all proprietary materials.

8. Limitation of Liability

Our liability is limited to fees paid in the 12 months preceding any claim. We're not liable for indirect damages, lost profits, or player disputes. Your insurance should cover operational risks.

9. Governing Law

These terms are governed by the laws of Malta. Disputes are resolved through arbitration in Malta under UNCITRAL rules.
